Terms and Conditions for Horncastle Place Cottages

Known as ‘Woodpeckers’ and ‘Deerkeepers’

These terms and conditions provide you with the basis upon which we accept your booking and charges for its services. By confirming the booking you are accepting these terms and conditions as provided in document form or on the Horncastle Place Cottages website.

This agreement is made on the basis that (“the Property”) is to be occupied by you for a holiday as mentioned in the Housing Act 1988 Schedule 1 Paragraph 9. You acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise on the determination of the Term.

DAMAGES DEPOSIT
Details of a credit/debit card are required in lieu of a damage deposit and we reserve the right to pre-authorise the card for up to £250 for this purpose. We do not debit your card for the damage deposit at the time of booking but you hereby authorise us to debit the card in the event of any damages or excess cleaning charges subsequent to your stay. The card details will be destroyed two weeks after an inspection of the property at the end of the rental period.

HOLIDAY LETTING PAYMENT
Deposit
You must pay a non-refundable deposit of 30% of the total cost of the holiday at the time of booking.

Balance Payment
Full payment of the balance will be due eight weeks prior to the first day of the booking.

Cancellation by us
Should we need to cancel the booking all monies paid by you shall be refunded in full.

Cancellation by the Guest eight weeks or more prior to the Booking Start Date
Should you need to cancel the booking all monies paid by you shall be refunded provided that such cancellation is made eight weeks prior to the first day of the letting

Cancellation by the Guest less than eight weeks prior to the Booking Start Date
Should you need to cancel the booking less than eight weeks prior to the first day of the letting you will remain liable for all costs due under the booking for the whole period or for such part of the booking which is less than eight weeks from the cancellation date. Payment must be made in full even if at the time of cancellation only the deposit has been paid to us. We recommend that you take out holiday cancellation insurance at the time of booking. In the event of the owner reletting the Property for the duration of the cancelled period we shall endeavour to refund up to 50% of the total cost.                     

ARRIVAL

Arrival is after 4pm unless previously arranged with us.

Key collection
Horncastle Place Cottages are fitted with a key safe and you will be informed of the combination by e-mail or letter, a week before the booking start date.     
                                 
CONDITION OF THE PROPERTY
Horncastle Place Cottages obligations We shall ensure that the Property is let in a clean and tidy condition. Alterations You must not damage or injure the Property, make any addition to the Property, or make any alteration to the Property or to the services or service media in the Property. Contents You must maintain the contents and the Property in the same state and condition as at first day of the letting. You should report any damage and pay to us the value of any part of the Property or its contents damaged or destroyed which are incapable of being restored to their former condition. Repair Under no circumstances should you attempt repairs to the Property or its contents. You must report any damage or faults in the Property or its contents to us immediately.   

RIGHTS OF ENTRY
You must allow us, with any necessary contractors and workmen, to enter the Property at reasonable times upon prior notice or in the event of emergency at any time without notice, to view the state and condition of the Property and the contents should we have any concerns; and to carry out any repairs that are necessary to the Property that can only be carried out by having access to the Property.       

DEALINGS
This agreement is personal to the Lead Guest. You must not transfer, sublet or part with or share possession of the Property or any part of it.           

USE AND NUISANCE
Residential holiday use You must use the Property for the purpose of a private holiday residence for a maximum of listed occupancy persons only and not for any other purpose. Nuisance You must not do anything on the Property that may reasonably be considered to be a nuisance or annoyance to our neighbours or us. Pets You must not keep or allow any animal in the Property. Smoking A Horncastle Place Cottage is strictly a non-smoking Property. Noise You must not play any musical instrument or device and must not allow noise from any machine or equipment to be heard outside the Property in such manner that may cause a disturbance after 2300 hours or before 0800 hours on any day. Guest Numbers  Only the guests whose details have been provided at the time of booking will be permitted to stay at the Property.

RETURNING THE PROPERTY AT THE END OF THE LETTING
Giving back possession You must hand over all keys to us by 10am on the final day of the letting and give vacant possession of the Property and the contents back to us, in a clean and tidy condition. If you fail to do so, we reserve the right to charge the minimum sum of £50.00 for cleaning costs and this sum will be deducted from the deposit. Items left We will not be responsible for any loss of valuables during the letting period of any property left by you at the end of the letting.   

RECOVERY OF POSSESSION
We may recover possession of the Property during the letting if you breach these terms

SAFETY RESPONSIBILITY
We will not be held responsible for the loss of any valuables or property left on or around the premises at any time. All guests, their friends, families and visitors must ensure that they take all reasonable steps to ensure their own safety and that of others whilst on the property. The owners will not accept responsibility for any injury or loss caused whilst in or around the property.

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or email.
